Indeed but at the very least this one has a good reason not to be used-he would obviously get in the way of everyone else's fights and Aizen used Wonderweis to seal Yama's flames. Let's not kill the mood cuz this was a good chapterWhether it's a good chapter or not he'll still ruin the mood, that's what people like him always do, it hurts seeing a good chapter/episode from a manga/anime you hate you know.

what are the chances that yama's bankai be stolen?

Since his blade melted instantly I expect him to either steal that Bankai or do his own. THEN after he wins he might steal it for himself giving rise to a whole new overpowered battlestyle(in other words making himself even more powerful for the last fight with Ichigo).
